WAIVER, RELEASE AND ASSUMPTION OF THE RISK

PLEASE READ CAREFULLY AND SIGN BELOW ONLY IF YOU ARE SATISFIED THAT YOU UNDERSTAND IT IN FULL. IF YOU HAVE ANY QUESTIONS, PLEASE ASK. 

HOLD HARMLESS CLAUSE 

I hereby acknowledge and agree that in consideration for my child’s (childrens’) participation/membership at Sunset Dojo, ltd., llc dba ‘TUMBLEKICK’ that I hereby release, waive, and discharge Sunset Dojo, ltd., llc dba ‘TUMBLEKICK’ and its directors, employees, volunteers, or fellow members from all liability on behalf of the minor(s) and on behalf of myself, as parent or guardian or other legal representative, for any and all claims, demands, losses or damages on account of any injury, death or damaged property arising out of any negligence relating in any way to participation in the activities offered by TumbleKick and that take place in its facility.

ASSUMPTION OF THE RISK

Student member(s), and if a minor(s), parent/guardian, understand that participating in the activities offered at Sunset Dojo, ltd., llc dba TumbleKick is purely voluntary. These activities include, but are not limited to, martial arts techniques and training, gymnastics techniques and training, fitness activities, tumbling techniques including but not limited to the use of spotting equipment or spotting by instructors, gymnastic equipment including balance beam, parallel bar, TumbleKick AirTrack, or other equipment not specified. It is understood that participating in the activities can, in some cases, cause injuries, including potentially severe injuries, and severe social and economic losses. 

Student member(s) and parent/guardian are familiar with the potential risks involved in all activities aforementioned and will continue to ensure that they are familiar with the potential risks involved in such activities the member(s) will participate in prior to the initiation of such participation. Student member(s) and parent/guardian assume all such risks. 

In addition, Student member(s) and parent/legal guardian do not know of any physical issues or limitations that would impact the ability to safely participate in the activities/programs. If based on the recommendation of a medical provider, or in my own belief, health issues arise that may impact my or the participants’ ability to participate, I will notify TumbleKick by email or other writing of such information before continuing my participation.

I, being the parent or guardian of the person(s) named in this membership agreement, hereby acknowledge and agree.

1. I have read the whole of this document and understand its contents. 
2. I consent to the person(s) named to participate in all activities at TumbleKick. I am aware of the risks, dangers, and obligations set out above in the acknowledgment and release. In consideration of the minor(s) participating in the activity, I agree to the release and indemnify Sunset Dojo, ltd., llc (dba ‘TumbleKick’) in the same manner and to the same effect and the extent as if I were the person(s) first named in the above. I further assume the risks of injury on behalf of the named minor(s) and have the authority to do so.
